The courts have an overriding duty to promote justice and prevent injustice. In exceptional circumstances the court can stop a prosecution to prevent an abuse of process - SEE: abuse_of_process Your lawyers will have looked into this and decided against such an application. If the case results in a sentence, a substantial delay (not caused by the defendant) can form a strong point of mitigation - see this recent case. |
