The courts have an overriding duty to promote justice and prevent injustice. In exceptional circumstances the court can stop a prosecution to prevent an abuse of process - SEE: abuse_of_process

Your lawyers will have looked into this and decided against such an application.

If the case results in a sentence, a substantial delay (not caused by the defendant) can form a strong point of mitigation - see this recent case

Hi, a family member is going through hell after false accusations nearly 2 years ago. They had a trial scheduled for September, but this got rescheduled for December as the prosecution were not ready. The day before they were told that it had been cancelled and would be sometime in the new year, then told it would be April. They\'ve now just been told it\'s going to be June.



How many times can the prosecution delay this trial? The defence are all prepared, they are just waiting for the prosecution to provide their pre-trial information (don\'t know the proper term for this).



Any answers or comments would be most appreciated, this is causing a lot of stress for all the family.
