Re:Re:Appealing against sentence! Re:Appealing against sentence! Appealing against sentence!
Hi All - I have 2 days to decide whether to lodge an appeal or not against a conviction (I pleaded guilty at the Police Station, so earliest opportunity) This was for possession on 3.5 gms of Cannabis. The Police came to my house on a search warrant looking for items stolen from a postman\\Can anyone help how do I appeal against a sentence that was given in crown court it was not enough

Appealing against the conviction is usually a path that people who have denied guilt but been found guilty take. As you pleaded guilty and assisted the police, you are only able to appeal against the sentence. As the sentence you have received (£17 fine) is leanient to reflect the amount of cannabis in your possession (and you are lucky not to have had court costs added to it as well as your suspended sentence activated), I would just take the sentence and pay the fine. If you had challenged the legitimacy of the cannabis upon arrest/at the police station then the outcome may have been different for you. The cannabis(?) is likely to have been destroyed now and so unable to be tested. Hope this helps a little.

I feel that as I actually showed them where the Cannabis was, as they had missed it during the search and the fact they came looking for stolen items NOT drugs, would give me grounds for appeal. Also the black hash the took was of such poor quality that if tested it may come back as henna and not cannabis at all.

Any advice would be gratefully accepted

Thank You

Appealing against sentence!     (Posted on: 2012-10-26 13:33:14)

Hi All - I have 2 days to decide whether to lodge an appeal or not against a conviction (I pleaded guilty at the Police Station, so earliest opportunity) This was for possession on 3.5 gms of Cannabis. The Police came to my house on a search warrant looking for items stolen from a postman\'s bicycle, the search wasn\'t very good as it was myself who pointed to the Cannabis that they had missed during the search, I thought I would get a Police Caution (Cannabis Caution) but as the Police had no evidence against me for the Theft they had originally come to visit me in regards too, this matter was actually NFA\'d, I was taken to Magistrates but as on a Suspended Sentence was then hauled through the Crown Court too (All for £15 worth of Cannabis)
The Crown Court Judge thought it was all a joke and so gave me a fine of £2, £1 each for the Cannabis finds. There was 2.9 gms Herbal + 0.9 gms of Black Hash, totalling 3.8gm.
The Judge in his infinite wisdom fined me £1 on each offence and there is an additional £15 Victim Charges which anyone who gets a fine has to pay.
I was the only victim that day, I lost my stash and I was also banged up from 9am until around 5pm, I was also hauled before a Crown Court Judge as technically I was in breach of my suspended sentence, but because the charge was such a minor one,  he didn\'t activate the suspended sentence.
I feel that a £2 fine was unjust (its actually) £15 after victim surcharge.
Can I lodge the appeal myself and also I want to represent myself, can I do this?
