Whether or not your conviction is spent depends on the length of the sentence given for the offence. This runs from the date of the conviction. If you have been given a sentence of more than 30 months (2 ½ years) imprisonment, your conviction/s will never become spent. Depending on your age at the time of conviction, most convictions become spent after five years. If you were an adult at the time and received a term of imprisonment of more than 6 months but not exceeding 30 months (2 ½ years) the (Rehabilitation) period is 10 years. For periods of imprisonment up to 6 months the (Rehabilitation) period is 7 years. Note :- The Rehabilitation of Offenders Act has exceptions where you have to reveal spent convictions to employers (when the job concerns sensitive areas such as work with children and vulnerable adults, work in law enforcement and the legal system, and high level financial positions).
