Working in a court a defendant has the right to elect trial by jury on an offence which is classed as an either way offence so the magistrates court will commit a case to be heard at the local crown court. However there are some case which are classed as inditable only and these cases can only be heard at a crown court as they have a greater sentencing power, mags can only impose up to 6 mths custody. these offences are rape, robbery, murder, some drugs offences (usual intent to supply) etc etc. |
