Are UK Magistrate void of all common sense? (Posted on: 2016-06-01 22:43:28)
I was recently the victim of some criminal damage. The damage was carried out over 4 days and nights. A drunken drug using neighbour had some kind of issue and did the following damage.
Day 1: kicking doors shouting abuse late at night.
Day2: splattered house paint over front doors and buildings
Day3: glued front door locks and poured oil over door with threat to burn house
Day 4: damaged cars in street
Police where called constantly over the 4 days and during one 999 call the operator could clearly hear and kicking and shouting going on. paint marks lead directly to the house of the criminal and there was only one neighbour in the entire area that any resident had an issue with for being anti social. And it is a locked gated community so general public cant just walk in.
Police remarks were as follows: They would not arrest or warn or even ask the person to stop the anti social behaviour. UK Magistrate would not accept a police arrest without CCTV of the person actually doing the crime red handed.
That apparently there is NO arrestable crime of criminal damage and the Magistrate is unable to process the over whelming other evidence and witness to the crime. only child proof CCTV will do the job.
Is this now the case in the UK? that our Magistrates are so weak minded and powerless that there is no crime unless its a crime in front of a dozen witnesses and on a CCTV camera?
