Other sentences can only ever serve as a guideline only to what sentence a court may impose. The court itself has sentencing guidelines to follow which are laid down in law, and these set out the appropriate range of sentences for the offence. In addition, judges take other factors in to account, such as the recommendation of the PSR (Pre-Sentencing Report), which will also influence the sentence handed down.
